“The matter of releasing Mazi Nnamdi Kanu is not an act of mercy, pardon, executive clemency, or even amnesty. Instead, it should be an act of simply complying with the subsisting Federal High Court judgment that declared his detention unconstitutional or even the extant international tribunal decisions that separately declared his detention unlawful.”.
According to a Punch newspaper, the lawyer pointed out that both Nigerian and international courts have already said Kanu’s detention is not legal. Kanu himself feels strongly that no one needs to beg for his release because he has not broken any laws. His lawyer explained that fighting for self-determination, which is what Kanu stands for, is allowed by Nigerian law and international organizations like the United Nations.
Ejimakor warned that asking for pardons might make things worse, as it could make people think Kanu did something wrong. He wants people to follow the example of groups like Afenifere and Ohanaeze, who say Kanu should be freed because he has not broken any laws.
“If truth be told, it is Nigeria’s executive branch, which extraordinarily renditioned Mazi Nnamdi Kanu, that should show contrition for resorting to extraordinary rendition—a state crime under international law and common law.”.
The IPOB leader must go to court on Monday to see Judge Binta Nyako in Abuja. This comes after Kanu asked for his case to be moved to the South-East if no other judge in Abuja wants to handle it besides Justice Nyako.
